So i'm studying rules for the test, i'm still at the beginning, but i am now watching a yt video about a dui case, where the person refused to be tested for their alcohol level. I think it was in the states, but i'm not sure.

I just wanted to ask if that's a thing that you can do? Without consequences ofc? Cause as far as i've studied, the refusal to cooperate for an acohol level test or drug level test could lead to 1 to 5 years in jail in our country.

I just got the part where they got a warrant from a judge to do a blood level alcohol test, she had 3 times the legal limit...

the laws for alcohol level tests when driving depend in which state you're in, but generally, there are consequences for refusing a breathalyzer or blood alcohol test when you are suspected of driving under the influence or driving while intoxicated the consequences might be the suspension of your driver's license

It’s hard to talk about US laws as a whole because as others have said, it varies by state. Oftentimes you theoretically can refuse it as far as I know. But oftentimes you get a penalty for doing so. Could be a temporary suspension if your license. Could be them getting a warrant to do a blood test. I’m sure there’s more penalties as well throughout the country.

Even if you refuse it it’s not like that means they have no case against you. If you’re clearly drunk refusing the test won’t protect you in reality. If you’re even thought to be somewhat drunk they also have other ways of getting the information if they want it.
