It's both the snake and the tortoise (most of the artwork I've seen of the Black Tortoise has a snake wrapped around the tortoise).

There different reasons that the Black Tortoise is a tortoise with a snake wrapped around. One reason is snakes and tortoises are symbols iof longevity in Ancient China. Another is to represent two genders, female and male. The tortoise being female and the snake being the male. Other source says that the intewined tortoise represents a state of interal struggle
