Court orders The Givers and CEO Ahn Sung-il to pay 499.5 million won in damages
[OSEN=Jee Min-kyung Reporter] Attrakt, the agency of group Fifty Fifty, partially won a damages lawsuit related to the 'tampering allegations' involving The Givers CEO Ahn Sung-il and others.
On the 15th, the 33rd Civil Division of the Seoul Central District Court (Presiding Judge Choi Jong-jin) ruled in partial favor of the plaintiff, Jeon Hong-jun, CEO of Attrakt, in the damages claim lawsuit he filed against The Givers CEO Ahn Sung-il and Director Baek.
The court stated, "The Givers and Ahn Sung-il must jointly pay 499.5 million Korean won to the plaintiff, and Director Baek must jointly pay 449.5 million Korean won with The Givers and CEO Ahn."
It added, "80% of the litigation costs will be borne by the plaintiff, and the remainder by the defendants," and noted, "The first clause (compensation amount) can be provisionally executed."
Fifty Fifty previously filed an application for a suspension of the exclusive contract’s effect against Attrakt in June 2023. Their stance was that trust had been broken due to Attrakt’s opaque settlements and failure to fulfill health management obligations for members. However, the court dismissed the request, and they subsequently filed an appeal.
Member Kina, however, did not join the other three members and independently submitted a withdrawal of the appeal, returning to Attrakt. Notably, after her return, Kina claimed that The Givers’ CEO Ahn Sung-il, a producer affiliated with Fifty Fifty, was behind the controversy. The suspension was again dismissed in the second trial.
Attrakt filed a damages lawsuit worth 13 billion Korean won against Saena, Sio, and Aran, former members of Fifty Fifty, and their co-perpetrators involved in the unjust termination of exclusive contracts.
At the time, Attrakt stated, "We filed a civil lawsuit against Saena, Sio, and Aran for damages and penalty fees due to breach of exclusive contracts, and against The Givers’ Ahn Sung-il, Director Baek, and the parents of the three members for damages caused by joint illegal acts in the unjust termination of the exclusive contracts."
During the trial, Attrakt claimed, "There are traces of embezzlement exceeding 150 million Korean won through unauthorized work contracts. They committed illegal acts such as refusing advertising offers and deleting email accounts."
In response, The Givers argued, "The work contract was not unilaterally terminated but mutually agreed upon," and countered, "The Givers had almost no involvement in the dispute between Attrakt and the Fifty Fifty members."
