Here's the problem with this. What swings one way, can invariably swing the other to the same or greater extreme. Not to mention how do you legally define homophobia? Speech in all it's forms must remain free. Even when it hurts.

It all depends on how "hate speech" is defined. If it's encouraging violent actions yes then its "hate speech" but it's a slippery slope that goes both directions.

It's still really vague and doesn't explain what hate speech is. I believe the term in the US is "actionable hate speech". This is where hate speech becomes illegal. It's a good distinction because it draws a definable line. Actionable hate speech means hate speech that engenders or encourages crimes (not just violence) against someone based on race, gender, sex, etc.. If you leave it as just hate speech it's to vague and anyone can be caught up. Simply being emotional and saying "I hate you to someone" could get you sent to prison. Is that right, or fair? People can only truly hurt you if you give them permission. Listen to those who love you and not to those who don't.

Ha, I'm sorry I can't help but pick these things apart and see the ramifications. I see how quickly free speech is erased, starting in ways "that can't possibly be bad but in the end that's the very way government's, dictators, and degenerates take away your rights. Like the lobster in a cook pot you don't know it's happening until you have no freedoms left. It sucks when people express their hatred to you but it gives you the chance to be a better person by not hating them back.
