Lawmaker Lim explained, "The parts where the 52-hour working hour is well settled will continue (be maintained)," adding, "Those who work in the new field can only accept flexibility (up to 69 hours) if the labor and management agree with each other and the workers' representatives agree to amnesty."
"Under the Labor Standards Act, violating the 52-hour system is punishable by imprisonment for up to two years or a fine of up to 20 million won, so if you work more than 52 hours, the employer becomes a lawbreaker and the worker becomes free labor," said Assemblyman Lim.
Regarding overtime work, he emphasized the precondition that "it is possible only with the consent of the worker, not without the consent of the worker," and that "furthermore, there must be a written agreement with the workers' representative."
Explaining the working time savings system, Congressman Lim said, "For example, if you want to save and use extended working hours, you have to give 1.5 times. If you worked 43 hours (overtime), you would have 660 hours of vacation and 82 days of vacation."
He continued, "There are voices of concern among the MZ generation and the labor community, saying, 'It is difficult to take annual leave now, it is difficult to use it well, it is difficult to take parental leave, but there are doubts about whether these holidays can really be used, and this is because there is a deep bone of mistrust in labor and management right now. Things that we have to overcome in the future."
Assemblyman Lim said, "Even when flexible working hours were chosen, there was no reduction in the monthly basis to reduce long hours, but the overtime hours were reduced by 10% on a quarterly basis, 20% when viewed semiannually, and 30% (working hours) when viewed on an annual basis."
Assemblyman Lim said, "It is true that I did not reflect delicately on the issue of Guarosa," adding, "I will listen carefully to various important words today and reflect on them." Guarosa, which is currently recognized as an industrial accident, is recognized as guarosa when it has worked an average of 60 hours for four consecutive weeks.
Kwon Ki-sup, Deputy Minister of Employment and Labor, explained, "The introduction of the 52-hour system while maintaining the rigidity of the system is causing widespread comprehensive wages in the field and illegal and unfair practices of not managing free overtime and working hours."
Deputy Minister Kwon said, "I understand that there are concerns about overtime without fair compensation and whether the system will be abused," adding, "In the end, in order for us to secure the sovereignty of working hours, it is an issue that must go hand in hand with the improvement of the law and the improvement of practices and awareness, so if you give us a lot of opinions, we will reflect them well during the legislative notice period."
The discussion was chaired by Professor Lee Seung-gil of Ajou University, and Yang Jung-yeol, director of the Working Time Policy Group of the Ministry of Employment and Labor, gave the presentation. The panel will be attended by MZ generation labor unions, related industries, and experts, including Yoo Jun-hwan, chairman of the Refresh Workers' Council, Cho Ki-hyun, representative of UN Fine Co., Ltd., Yoo Jae-eun, youth policy coordinator at the State Affairs Coordination Office, and Noh Min-sun, research fellow at the Small and Medium Venture Enterprise Research Institute.
Earlier, the Ministry of Employment and Labor announced plans to revamp the working hour system, such as allowing a maximum of 69 hours of work per week. The overtime time management unit of "one week" was expanded to "monthly, quarterly, semi-annually, and yearly units" to enable flexible intensive work, but criticism was voiced such as concerns about long-term work.
On 14 March, President Yun instructed, "Carefully listen to the various opinions of workers expressed during the legislative notice period, especially those of the MZ generation, and consider the contents of the bill and the points that can be supplemented with the communication with the public." In response to such instructions, the People's Power Hwan Labor Committee plans to start with this debate and then conduct site visits and generational and class meetings to supplement the system to gather public opinion.

국회 환경노동위원회 여당 간사인 임이자 의원은 이날 오전 국회 의원회관에서 '근로시간 제도 개편 방향 토론회'를 주최하고 "(개편안은)1주 단위의 획일적, 경직적 규제를 개선하고 건강권과 휴식권을 보장하기 위해서 실근로시간을 단축하는 것이 핵심 골자"라며 "개편 취지가 비현실적 과장을 토대로 한 가짜뉴스와 소통 부족 등으로 장시간 근로를 유발한다는 오해를 야기하고 있다"고 지적했다.
임 의원은 "지금 현재 52시간 근로시간이 잘 정착돼 가고 있는 부분들은 그대로 쭉 간다(유지된다)"며 "새로운 분야에서 일하시는 분들은 노사가 서로 합의를 통해, 근로자 대표가 사면 합의를 해줘야만 (최장69시간이라는)유연성을 받아들일 수 있는 것"이라고 설명했다.
임 의원은 "근로기준법상 52시간제 위반시 2년 이하의 징역 또는 2천만 원 이하의 벌금을 물도록 돼 있기 때문에 52시간을 초과해서 일을 했을 경우에는 사용자는 범법자가 되고 근로자는 공짜 노동이 된다"며 "사용자도 범법자를 만들지 않고 노동자도 공짜 노동을 하지 않는 방법으로 고용노동부가 접근했던 것"이라고 말했다.
이어 추가 근로에 대해 "노동자의 어떤 그런 동의가 있어야만 가능한 부분이지 노동자의 동의 없이는 안 되는 것"이라며 "더 나아가서 근로자 대표와 서면합의가 돼야만 한다"고 전제 조건을 강조했다.
임 의원은 근로시간 저축제도에 대해 설명하며 "예를 들어 연장했던 근로시간을 저축해놨다가 사용하고자 했을 때는 1.5배를 줘야 한다. 43시간을 (추가근무)했을 경우에는 휴가가 660시간, 82일의 휴가가 생기는 것"이라고 말했다.
이어 "MZ 세대들이나 노동계에서 우려하는 목소리가'지금 연차 휴가를 쓰는 것도 눈치가 보이고 잘 쓰기 어렵고 육아 휴가 내는 것도 어려운 상황인데 이런 휴일들이 정말로 쓸 수 있겠느냐 하는 의구심이 있는데 지금 노사가 불신의 골이 깊기 때문에 일어난 부분이다. 앞으로 극복해야 할 일들"이라고 덧붙였다.
임 의원은 "유연한 근로시간을 선택했을 때도 장시간 근로를 줄여주기 위해서 월 단위는 감소가 없지만 분기별로 봤을 때는 10%, 반기별로 봤을 때는 20%, 연단위로 봤을 때는 30% (근무시간을)감축시켜서 연장 근로시간을 축소했다"며 "모든 노동자에게 69시간을 하라는 그런 취지는 절대 아니고 노사가 선택할 수 있는 그 유연화의 폭을 넓혀놓은 것"이라고 강조했다.
임 의원은 "과로사와 관련해서는 섬세하게 반영하지 못했던 부분이 맞다"며 "오늘 여러 가지 중요한 말씀을 잘 경청해서 반영하도록 하겠다"고 말했다. 현재 산업재해로 인정하고 있는 과로사는 4주 연속 평균 60시간 근무했을 때는 과로사로 인정하고 있다.
권기섭 고용노동부 차관은 "제도의 경직성을 유지한 채로 52시간제가 도입되다 보니까 현장에서 포괄임금이 만연되고 있고 공짜야근, 근로시간 관리를 안 하려고 하는 불법부당한 관행들이 야기가 되고 있다"며 "이번 개편안 취지는 주 평균 52시간 내에서 업무량 변동에 따라서 업무 시간을 노사 합의에 따라 탄력적으로 조정할 수 있도록 하고, 근로자에게 충분한 휴식과 건강을 보장해 궁극적으로 실 근로 시간을 단축하려고 한다"고 설명했다.
권 차관은 "현장에선 정당한 보상 없이 연장근무를 하지 않을까, 제도가 악용되지 않을지 우려가 있는 것도 잘 알고 있다"며 "결국 우리가 근로시간 주권을 확보하기 위해선 법 개선과 함께 관행과 의식 개선이 같이 가야 되는 문제이기 때문에 많은 의견을 주시면 입법예고 기간에 잘 반영하겠다"고 했다.
이번 토론회에선 이승길 아주대학교 교수가 좌장을, 양정열 고용노동부 임근근로시간정책단 국장이 발제를 맡았다. 토론 패널로는 유준환 새로고침 노동자협의회 의장과 조기현 주식회사 유엔파인 대표, 유재은 국무조정실 청년정책조정위원, 노민선 중소벤처기업연구원 연구위원 등 MZ세대 노동조합과 관련 업계, 전문가가 참석한다.
앞서 고용노동부는 주당 최대 69시간 노동을 허용하는 등 근로시간 제도 개편방안을 발표했다. '1주 단위'로 된 연장근로시간 관리 단위를 '월·분기·반기·연 단위'로 확대해 탄력적 집중 근로가 가능하게 했지만, 장기간 근로 우려 등 비판의 목소리가 나왔다.
이에 윤 대통령은 지난 14일 "입법예고 기간 중 표출된 근로자들의 다양한 의견, 특히 MZ세대의 의견을 면밀히 청취해 법안 내용과 대국민 소통에 관해 보완할 점을 검토하라"고 지시했다. 이같은 지시에 국민의힘 환노위는 이번 토론회를 시작으로, 이후 제도 보완을 위한 현장 방문 및 세대별, 계층별 간담회를 진행해 여론 수렴에 나선다는 계획이다.
