I don't think tombstone should fall into copyright, it's commission and not sth the company who engraves is advertising or selling as products.

They could probably get amateur engrave it if not professional company as commission anyways. Sometimes going the right way- asking permission from company and such is not best way to approach things.

cakes are Copy written and they are disposable, permanent markers are likely too.
But as you say I can put spider-man on my cake all day long, but no store or cake shop can with out using official licensed stuff..
The cemetery would seem to be standing in the way of an amateur engraving.

I guess, if cemetary approves and looks that close to tombstone engarvings.
