SM places provisional seizure on 2.6 billion won assets of Chen, Baekhyun, Xiumin
EXO-CBX members Chen, Baekhyun, and Xiumin have had assets worth 2.6 billion Korean won subject to provisional seizure.
According to the music industry on the 11th, SM Entertainment (hereinafter SM) recently placed provisional seizures on the assets of Chen, Baekhyun, and Xiumin over two days, on the 9th and 10th. The seized assets include Chen’s housing deposit receivables, Baekhyun’s apartment in Acheon-dong, Guri City, Gyeonggi Province, and Xiumin’s apartment in Hannam-dong, Yongsan-gu, Seoul.
SM claimed 300 million, 1.6 billion, and 700 million Korean won from Chen, Baekhyun, and Xiumin, respectively, totaling 2.6 billion Korean won through this provisional seizure. Provisional seizure is a measure to prevent the opposing party from disposing of assets, aiming to preserve claims for 10% of individual activity sales arising from the agreement reached in June of last year.
Chen, Baekhyun, and Xiumin notified SM of their intent to terminate their exclusive contracts through legal representatives in June of last year, after renewing their contracts. The reasons cited were an unfairly long contract period and opaque settlements. In response, SM stated, “We have cooperated by allowing artists to visit and review settlement data whenever requested,” and refuted claims about the contract period, emphasizing that the contract’s validity and legitimacy had already been recognized by the Supreme Court. SM also explained that the trio’s renewed contracts were signed after sufficient discussions with the company, with assistance from top-tier law firms, without any coercion as the original contracts were nearing expiration.
Subsequently, both parties reached a mutual agreement: EXO group activities would continue under SM, while individual and unit activities would proceed under the independent label INB100, with 10% of individual activity sales paid to SM. However, tensions escalated after a leaked recording containing MC Mong’s alleged tampering remarks was released, followed by INB100 joining a subsidiary led by MC Mong the following year, raising suspicions of tampering.
Specifically, EXO-CBX argued that SM failed to honor a commitment to guarantee a 5.5% distribution fee rate for albums and music to the independent label INB100, and thus refused to fulfill the agreed 10% payment of individual activity sales. This deepened the conflict. EXO-CBX filed a fraud complaint against SM executives, but it was dismissed due to insufficient evidence.
Additionally, in October of last year, conflicts resurfaced over the failure of EXO-CBX to join EXO’s full-group activities. After the second mediation session for a 600-million-Korean-won civil lawsuit regarding contract fulfillment, EXO-CBX stated, “We clearly communicated our intent to accept all conditions proposed by SM for EXO’s year-end full-group comeback.” However, SM countered, “We had prevailed in all previous disputes, and our sole demand was the unpaid 10% of individual activity sales as stipulated in the June 18, 2023 agreement.”
SM further stated, “The issue of participating in team activities cannot proceed due to the significant breakdown in trust caused by numerous disputes, the damage inflicted on the EXO team, and the hurt caused to fans and members. The natural order would be for the trio to first sincerely fulfill the existing agreement and work toward restoring trust. However, contrary to their claim of accepting all conditions after the October 2nd mediation, they filed an objection on the 16th.”
Meanwhile, amid the exclusive contract dispute between EXO-CBX and SM, EXO held a fan meeting titled ‘EXO’verse’ in December of last year and released their eighth full album ‘REVERXE’ on the 19th of last month. The members, who made a comeback with the title track ‘Crown,’ are scheduled to hold ‘EXO PLANET #6 - EXhOrizon in SEOUL’ at KSPO DOME for three days, from the 10th to the 12th of this April.
