I don't know Canadian laws, but I don't think it's illegal if you genuinely didn't know.

Flip side of this: my dad told me a story once about how a mail carrier didn't notice that one of the "zombies" decorating a guy's porch was actually a dead person. Apparently a neighbor complained or something that the mailman should have noticed but it was Halloween and there were other fake full-sized zombies decorating the property, so he didn't realize that one of the ones on the porch swing was the homeowner who must have had a heart attack or something and ended up dying.
