If you become intoxicated by the doing of someone else, or if you are intoxicated beyond a normal mental capacity it is still illegal. It has always been dealt with on a case by case basis, so unfortunately this is nothing new. Its just written down. Many people have gotten away with rape because the victim basically wasn’t intoxicated enough. I’ve said this over and over again, the Canadian legal system is completely fucked up. Canada basically has issues all around and its not what people think it is. I still know tons of people who think its the glory land but its not. You mentioned the residential school graves, that brings up a whole other issues of how fucked Canada is. Leaders stole land from the Indigenous peoples, put them into residential schools and abused them to white wash them. Its very sick. as i read the decision it said the offender was drunk.
Nothing about the victim being under the influence.

the law they overturned was in response to another decision where the court ruled that a guy was innocent of the rape of an elderly woman cuz he was too drunk.

I have never ever thought being voluntary drunk/high was a mitigating factor at all. a person chose to get drunk . its like robing a bank with a weapon you didn't mean to kill anyone but oops someone died. too bad M1/2 depending on the place.

If the person is passed out sure they aren't going to consent, but if drunk then there are nuances that should be considered. I've been in occasions where I have had the equivilant of 4 margaritas, 2 wine coolers, 2 shots of scotch, 2 shots of moonshine, and a couple of beers and still was coherent enough to consent to sex. Someone else may be barely able to keep their eyes open.

There also have been studies that shown that intoxication reduces one's level to care if they are violating social norms, but still having an understanding that its wrong. For instance, a religious person may get drunk and have pre-marital sex even though its wrong according to their beliefs because they have lost the capacity to care about what they typically feel is morally right. The problem here is how is rape differentiated from drunken sex or is all sex when one is intoxicated considered rape. If this is the case then everyone who is currently on methamphetamines [a drug that notoriously increases one's libido] and engages in sex is considered a rapist.

Given this, a woman is going to have less of a tolerance to heavy drinking and as such the consumption of spirits that I detailed in my example of my occasional drinking would likely place a woman in a place where she is not able to consent. However, the same rules do still apply. If we agree that not all drunken sex is rape then a discussion should be had to when is one not able to consent? I think we can all agree that if someone's eyes are fluttering that it would be inappropriate to have sex even if it is initiates by him or her.

i am not sure even videoing the consent let alone signatures would be enough. especially if all parties are in a less than sober state.

Similarly, it is also popular for them to use Meth prior to it as well. And then when using meth one is less likely to use condoms, which makes the risk of HIV transmittion easier since anal intercourse is the easiest way to contract the disease. But then there's the consideration of whether if I have an STI [say Herpes] and I know it and I don't tell you before sex, is that considered rape since the other person would not engage in sex with someone with an STI. And then we get into the conversation of how much information does someone need to know about the other person prior to sex and whether casual sex is a good idea at all... and when we start pathologizing such people it can make it trivial for those actual predators who I get cards about in the mail saying x person has moved into my neighborhood and who was convicted of kidnapping and raping a 25 year old female habitually.
