Is drunk driving a worse offense if someone dies? If you drive drunk and don’t kill someone you didn’t do anything differently than if you drove drunk and killed someone. The other factor as to whether someone dies really just comes down to luck. For me when someone drives drunk, they drive drunk, and the only things that can change severity are maybe how drunk you are, but not the outcome of that particular event.

Yeah exactly, I thought too of if some tried to shoot someone and miss because it wouldn’t be due to a better character than if they didn’t miss. But I like yours better because my example does have an intent to wound or kill while yours is more similar to drink driving, where the intent isn’t to kill or harm, but it’s still a reckless decision that can harm someone due to the persons negligence.
